In an out-of-court sum m er se ttle m ent o f the Fresc and Ford sex dis crim ination lawsuits against the University, N otre Dame denied a his tory of discrim ination against female faculty in tenure and con tract deci sions. The University, how ever, did make substantial concessions to the plaintiffs The 16-page settlem ent, ap proved by U.S. District Judge Allen Sharp on July 31, consists o f the following provisions: •Ms. Fresc, w ho initiated the class action suit on grounds that the University violated the Civil Rights Act o f 1964, will becom e a tenured faculty m em ber in the English D epartm ent and receive back pay from Sept. 1, 1980. •T he Frese settlem ent also re quires the establishm ent o f a review panel for o ther m em bers o f the class action suit w ho con tend they w ere discrim inated against. This Appeals C om m ittee — agreed to by a tto r neys for both sides — consists o f two men and one woman. They are: Professor Ann Ida Cannon o f the Chicago based M undelein College, Professor David C. Leege and Profes sor Charles K. Wilber, bo th o f N otre Dame •N o tre Dame m ust also establish an appellate p rocedu re for w om en who, in the future, believe they may have been discrim inated against on faculty prom otions. •Ms. Ford, after reaching a separate settlem ent w ith the Univer sity, dismissed her case. She will be prom oted to the rank o f professor in the Theology D epartm ent and also receive com pensation from Sept. 1, 1980.
